This talk will look at recent developments in the law of prescription and limitation. In particular, it will examine some prescription problems arising in current practice from the decisions in Gordon’s Trustees v Campbell Riddell Breeze Paterson [2017] UKSC 75, as recently applied in Midlothian Council v Blyth & Blyth [2019] CSOH 29. It will also look at the corresponding provisions of the Prescription (Scotland) Act 2018 (not yet in force).
